Borough Council Meeting Minutes

August 2, 2000

A special meeting was called to discuss retaining a new Solicitor for the Borough of New Albany. The following were in attendance: Linda Abrams, Janet Bouse, Karon Hugo, Bill Thompson, David Hindman, Dan Dunham, Phyllis Sturdevant and Elaine Shirk.

The meeting was called to order at 8:15 PM. Discussion centered on the lack of service and satisfaction with service received from Niemiec, Smith and Pellinger, the Borough’s current Solicitor.

Dave has spoken to a couple of different Attorneys in this regard. One was not doing any municipal work at the present; the other Osmond & Thompson of Main Street, Towanda is handling other Townships in the area and is involved with municipal law. Their billing rate is $70.00 an hour vice $150.00 an hour that we are paying Niemiec. There is no retainer vice $600.00 a year for Niemiec; they do add 5% to bills to cover copies, etc.

Dave presented a resolution to appoint the firm of Osmond and Thompson to be the Borough’s new Solicitor to the Council. Janet Bouse made a motion to accept the resolution to appoint Osmond and Thompson as our Solicitor. Bill Thompson seconded the motion and the vote was unanimous.

Dave will fax a copy of the resolution to our new attorneys. He will also fax a copy of our proposed water ordinance to them to review.

Janet Bouse made a motion to adjourn the meeting. Meeting was adjourned at 8:30 PM.
